Maximizing Market Share: Discovering What Drives Consumer Choice in Personal Injury Representation
A leading personal injury law firm in Wisconsin needed to understand the motivations behind consumers’ decisions when choosing legal counsel.
With a strong reputation in the personal injury space, the firm had recently begun to face increased competition from non-credentialed firms aggressively marketing themselves to potential clients, particularly within the auto injury sector, and chipping away at the firm’s market share.
While previous insights and consultation provided by The DRG had revealed valuable intel on the firm’s overall brand awareness, the emergence of this new competitive threat demanded a deeper understanding of consumer decision-making.
legal
In particular, the law firm wanted to know:
- How aware are consumers of local personal injury attorneys and how do they perceive them?
- What drives their decisions in selecting legal representation?
- How do advertising strategies—such as celebrity endorsements and testimonials—impact their choices?
Beyond these questions, the firm also recognized the importance of differentiating themselves to remain top-of-mind for consumers and wanted insights to help them ensure their longstanding reputation wasn’t eclipsed by flashier, less-established competitors.
The Solution
We focused on offering the law firm a comprehensive view of consumers’ legal decision process, as well as the optimal marketing strategies that resonate with those in need of a personal injury lawyer to ultimately help the firm best position themselves.
To address the firm’s questions and provide them with the insights they needed, we first engaged directly with the attorneys and internal marketing team to fully understand the context and needs behind their key questions. From there, we crafted objectives tailored to reveal key consumer decision-making factors, including:
- Identifying which personal injury law firms consumers were aware of and their perceptions of each
- Understanding the role and influence of personal recommendations versus advertising in decision-making around legal counsel
- Gauging the importance of law firm credentials, reputation, and experience in choosing representation for an auto injury
- Understanding consumer responses to different advertising strategies, such as the impact of celebrity endorsements versus client testimonials
Once we outlined the objectives, we developed a comprehensive, two-pronged approach to accomplish them. The first phase involved a quantitative phone survey aimed at gaining a broad understanding of consumer behaviors and perceptions around personal injury law firms across Milwaukee County, Milwaukee Metro, and non-Milwaukee areas. This was followed by in-depth qualitative interviews with willing participants from the quantitative phase, allowing for a more nuanced exploration of their motivations in choosing personal legal representation.
We designed the study this way to not only provide the firm with insights into higher-level patterns in decision-making, but also get at the practical and emotional aspects of why certain choices were made.
The Wins
Insights from our study directly addressed the law firm’s challenges and shed light on both their strengths and areas of opportunity.
We provided them with a comprehensive understanding of the factors influencing consumers’ decisions when choosing legal representation in the event of a personal auto injury. We also identified the top drivers of consumer decision-making in order of impact, offering the firm more extensive insights into the criteria most important to potential clients.
The design and scale of our study allowed us to uncover key differences by market and target audience. This enabled the law firm’s marketing team to tailor their messaging to resonate more effectively with specific demographic segments.
By analyzing a variety of data points—such as brand awareness, tagline recognition, and competitive positioning—we crafted a cohesive narrative to help the firm strengthen its standing in the minds of prospective clients. This story-driven approach was instrumental in highlighting areas of opportunity for the firm to enhance its visibility and reputation.
In our final report and during the in-person presentation of our findings, we provided the firm with several strategic recommendations, empowering their team to make informed decisions and implementations that would further solidify and protect their competitive position in the market.
